Order of dismissal of petition for creation of drainage district held not res adjudicata in subsequent proceedings.</p> <p>Where a petition to create a drainage district is dismissed before the final hearing, and no order is entered creating the district, such order of dismissal cannot he pleaded in har of a subsequent application to create such drainage district, even though che same territory is embraced in each petition.
