Syllabus

<p>Syllabus.</p> <p>The sheriff is not a necessary party to an appeal taken by a third opponent claiming property seized as that of defendant in the suit.</p> <p>An attorney is a good surety on an appeal bond 'even though he is engaged on a contingent fee for a part of the judgment in case of success</p> <p>A motion to dismiss an appeal for want of a bond must be made within three calendar days after the return day.</p> <p>A dation en paiement made by a husband to his wife in payment of her money claim against him, and interest thereon, which he does not owe under the law, is not necessarily an absolute nullity.</p> <p>The law does not require a dation en paiement to be recorded in the mortgage office, a registry in the Conveyance Office is sufficient.</p> <p>The law considers the delivery of immovables as always aecom' panying the act of sale or dation en paiement.</p>
