<p>Vendor and Vendee—Sale in gross—Deficiency—Case at bar.—Vendee purchased, for the sum of §6,000, a tract of land described in the contract of sale by metes and bounds, and as containing 274 acres, more or less, the vendor making no representations as to the number of acres. There was a deficiency of twenty-eight acres, and vendee made partial payments after becoming aware of the deficiency: held, it was a sale in gross, and vendee is entitled to no abatement of purchase-money on account of the deficiency.</p>
