Syllabus
<p>Judgments — Judgments entered on same day* — Execution—Distribution of assets — Reduction of one judgment by collateral agreement — Share of proceeds of execution.</p> <p>Where two judgments- are entered the same day and execution is issued thereon the amount to which each is entitled depends on the actual sum due on the judgments. Where one of the judgments has been compromised and reduced, and a collateral agreement executed setting forth the facts and defining the indebtedness, the assignee of such judgment, can only participate in the distribution, in proportion to the amount of the debt of the original judgment, as determined under the collateral agreement.</p>
