Syllabus

<p>Where by a mutual mistake between a vendor and a vendee the former, though holding title to one of two parcels of a tract of land, has conveyed to the latter, by a quit-claim deed, the parcel to which he had no title and received a bond in part consideration therefor, the vendee may set up the mutual mistake as a defence against the payment of the bond.</p>
