Syllabus

<p>Contract — Construction.—An obligation, in case of ambiguity* should, be construed in the light of the surroundings of the parties thereto.</p> <p>Motion tor Nonsuit. — A motion for a nonsuit upon the ground that “plaintiff has shown by his own evidence that he has no right of recovery in this action” properly overruled, as the statement of said ground is too vague, uncertain and indefinite to entitle the same to consideration.</p> <p>(Syllabus by the court.)</p>
