<p>Syllabus.</p> <p>1. The authority of the attorney of record to represent one whom he avers is his client will not be decreed to be at an end on the averment of another attorney not of record, unsupported by an oath or its equivalent. Succession of ■ Patrick, 20th Ann., 204; 8th N. S., 232.</p> <p>2. The transcript of appeal was died after the time fixed for its return. The appeal will be dismissed when the transcript has not been timely fi/ed.</p> <p>3. An extension of the time within which to file the transcript of appeal does ■ not include three days of grace. Archer vs. Gonsoulin, 46 A., 141; Dane vs. Caldweil and Kahn, 28 A., 790 ; Bienvenu vs. Insurance Co., 28 A., 901; Von Hoyen vs. Von Hoven, 43rd Ann., 1170.</p> <p>4. The facts fatal to the appeal being manifest, the appeal will be dismissed.</p>
