Syllabus

<p>A defendant who has not been served with process is not a competent witness for his co-defendants in an action of trespass.</p> <p>Where there was evidence before the jury, connecting such defendant with the trespass, Held that a motion by the other defendants to strike his name from the record, was properly overruled.</p>
