Gary V. Jenkins v. City of East Providence

Syllabus

The plaintiff, Gary V. Jenkins, appealed from the denial of his petition for writ of mandamus and dismissal of his complaint pursuant to Rules 12(b)(1) and 12(b)(6) of the Superior Court Rules of Civil Procedure. On appeal, the plaintiff claimed that the trial justice erred in concluding that res judicata barred his claims and that he had failed to establish the required elements that would entitle him to a writ of mandamus. <br><br>The Supreme Court concluded that the plaintiff failed to provide any meaningful discussion of the issues on appeal, as required by Article I, Rule 12A of the Supreme Court Rules of Appellate Procedure. The Supreme Court also concluded that the plaintiff's arguments were not raised in the trial court and were therefore waived. The Court noted, however, that even if the plaintiff's claims were properly before it, it was undisputed that the claims were barred by res judicata.<br> <br>Accordingly, the Supreme Court affirmed the order of the Superior Court.<br>
