Syllabus

<p>1. The act of May 28, 1870, sep. acts 1869-70, p. 162, to prevent the sacrifice of personal property at forced sales, which requires the officer selling personal property, for a debt contracted before the 10th of Aj>ril 1865,when required by the debtor, to sell upon a credit of twelve months, is not unconstitutional, as impairing the obligation of the contract, or as being in violation of s. 4, article 11, of the State constitution, prohibiting the enactment of a stay law.</p> <p>2. The bonds taken at sales under this act are in the nature of forthcoming bonds; and the creditor is not bound to receive them as so much paid on his debt.</p>
