Syllabus

<p>Where, on a rule to open a judgment entered by confession upon a mortgage bond executed by a married woman, it appeared that both the bond and mortgage showed that they were given for purchase money, and the testimony as to the averment of fraud in the procurement of them was conflicting, the discharge of the rule and refusal to open the judgment was not an improper exercise of the discretion vested in the court below.</p>
