Syllabus
Judgment affirmed. Appellee presented testimony, exhibits, and affidavits all to support the central premise that he never received a copy of the complaint. Appellant did not present any evidence to rebut appellee's assertion. The trial court did not abuse its discretion in vacating the default judgment as to appellee. In addition, appellant did not meet its reciprocal burden under Civ.R. 56(E) and consequently, the trial court did not err in granting summary judgment in appellee's favor.
