Future Contracting & Estimators, LLC v. Maelee Allen, Alias

Syllabus

The self-represented defendant, Maelee Allen, appealed from a Superior Court order that denied and dismissed her District Court appeal. The plaintiff, Future Contracting & Estimators, LLC, initiated this action in the Third Division District Court by filing a civil book account action seeking payment of $3,100 plus statutory interest from the defendant for the plaintiff's \estimating services for damages\ regarding the defendant's property located at 8 Warren Avenue in North Providence, Rhode Island. A judge of the District Court entered judgment in favor of the plaintiff on April 9, 2024. The defendant appealed the District Court judgment to the Superior Court. The Superior Court trial justice issued a decision finding in favor of the plaintiff. On appeal to the Supreme Court, the defendant contested the factual evidence presented at trial but failed to articulate any legal argument. Therefore, the Court deemed the defendant's arguments waived. The Court further determined that pursuant to Article I, Rule 11(a) of the Supreme Court Rules of Appellate Procedure, the defendant failed to provide all relevant transcripts to her appeal and, therefore, the Supreme Court could not review the lower court record for error. Accordingly, the Supreme Court affirmed the order of the Superior Court.
