Syllabus

<p>A certificate of stock was deposited as a pledge for the payment of a judgment note, with an agreement that, if the note was not paid, there should be a transfer of the certificate of stock to the creditor “to be his own property and in payment of the note.” Held, that the non-payment of the note at maturity and the receipt of monthly dividends on the stock certificate thereafter by the creditor did not effect such a transfer of the certificate as to cancel the note.</p>
