Syllabus

<p>1. Limitation.— A deed, possession under which, when recorded, will support the plea of five years’ limitation, must be an instrument o£ writing which, considered with reference to its terms, without regard to ex’raneous aids, assumes and purports to operate as a conveyance of the land. The question of power to make the deed is not involved. Hence a deed made by one who was really a married woman at the tim\\ though nothing on the face of the deed revealed that fact, and in which her husband did not join, will support the plea of five years’ limitation.</p>
