Syllabus

<p>Conditional Contract.—If, at the time an application was pending in the United States Courts for the confirmation of a Mexican grant, the grantee sold and conveyed the same, and the vendee agreed to pay the purchase price on the final confirmation of the grant, and the grant was afterwards rejected, the rejection released the vendee from his obligation to pay, even if an Act of Congress was afterwards passed under which the vendee pre-empted and acquired the title to the land.</p> <p>Conditional Note.—If a promissory note is made payable on condition that a proceeding, pending in the Courts, is decided in favor of the payee, and the proceeding is decided against him, the note cannot be enforced.</p>
