Syllabus
<p>Ejectment— Value of improvements — Equity.</p> <p>Where a plaintiff in an ejectment has recovered upon his legal title he cannot subsequently be compelled by a bill in equity to account for the value of the improvements placed upon the land by the defendant. In such a case the defendant has no claim other than such as it was his right and duty to enforce, either upon the trial of the ejectment, if the Act of April 12, 1842, P. L. 265 applied, or by way of defense to an action for mesne profits.</p>
