Syllabus
<p>Courts of appeals — Disability or disqualification of judges — Assignment of judges — By chief justices of court of appeals and supreme court — Section 1528, General Code — Section 6, Article IV, Constitution (1912).</p> <p>1. The chief justice of the court of appeals is, by the provisions of Section 1528, General Code, authorized, subject to the conditions set forth in that section, to assign one or all of the judges of one district to hold court in another district; and the section is not in conflict with the clause in Section 6, Article IV of the Constitution, which confers the power on the chief justice of the supreme court to determine the disability or disqualification of any judge of the court of appeals and to assign any judge of such courts to any county to hold court.</p> <p>2. Section 6 of Article IV of the Constitution clothes the chief justice of the supreme court with full authority to determine the disability or disqualification of a judge of the court of appeals, and in addition thereto to assign a judge of that court to any county to hold court for any proper reason, without reference to questions of disability or disqualification.</p>
