Syllabus
<p>Divorce — Domicile—Residence.</p> <p>A libel in divorce, based on cruel and barbarous treatment or indignities to the person must aver, as a jurisdictional fact, that the libellant bas been a bona fide resident within the Commonwealth for one year previous to the filing of the petition or libel. When the evidence fails to establish such a fact, the court is without jurisdiction and the libel must be dismissed.</p>
