Syllabus

<p>Vendor and vendee — Contract—Principal and agent — Statute of frauds — Beal estate.</p> <p>Where a real estate agent accepts hand money for a sale of real estate and gives a receipt which shows on its face that he had no authority to contract for the owner, and subsequently tenders an agreement signed by the owner, hut which the proposed purchaser refused to sign because it differed from the understanding which he had with the agent, the latter will be compelled to repay the hand money which he received.</p>
