Syllabus

<p>Judgment. Jurisdiction.—When a party has elected to proceed in Chancery in a case, the Superior Court will not entertain an application to set aside the judgment in such case until the matter is finally determined in Chancery.</p> <p>Practice.—Upon a motion to discharge a rule to show cause why a judgment should not be set aside, for want of jurisdiction, the Court will hear that motion first ; and the attorneys for the motion have the opening and the closing.</p> <p>Costs.—Upon the discharge of such rule the costs are to be paid by the petitioner for the rule.</p>
