Syllabus

<p>Appeal.—An Assignment of Error, on Motion for a New Trial, that the “evidence is insufficient to justify the third finding of fact, in that there is no evidence to show that there is due and owing plaintiff” a certain sum, is insufficient to question on appeal the sufficiency of the evidence to sustain such finding that no part of the principal has heen paid except a certain sum.</p>
