Syllabus

<p>1. If a bank, receiving a cheek upon another bank for collection, surrender the check to the drawee and receive a cashier’s check in lieu thereof, its liability to its depositor becomes fixed, as much so as if it had received the cash.</p> <p>2. The fact that the payee of the cheek had subsequently received from the drawer a sum of money on account thereof, would not establish a claim of set-off in favor of the collecting bank.</p>
