The interpretation of the parties' contract, which was not clear and unambiguous, was an issue of fact to be decided by the jury. Because a valid and enforceable contract existed between the parties, the trial court properly denied appellant's motion for summary judgment. The trial court abused its discretion by denying appellee's motion for prejudgment interest, as appellee was entitled to prejudgment interest as a matter of law.
