Syllabus

<p>In assumpsit for the breach of a contract of marriage, the defendant put in evidence a formal release executed by the plaintiff after the cause was at issue. Evidence in rebuttal, tending to show that the release was procured by fraud, was sufficient to warrant the submission of the fact to the jury, and the question of its sufficiency to reform or contradict the release did not arise.</p>
