Syllabus
<p>Guardian and ward — Loan of money to guardian without order of court —Pledge of minor's personal estate.</p> <p>Where a guardian borrows money for the alleged purpose of improving his wards’ real estate and pledges personal property of his wards as security for the loan, the person lending the money will be obliged to return the property pledged if it appears that there was no order of court authorizing the loan, and that the guardian had not used the greater portion of the money borrowed in improving the real estate, but had invested it in a corporation in which he was personally interested, and the money so invested was lost.</p> <p>An order of court permitting a guardian to improve his wards’ real estate out of the surplus income is no authority to him to pledge the personal property of the wards for money borrowed.</p>
