Syllabus

<p>Waters and Water Courses (42) — Diversion—Prior Appropriation — Remedies—Injunction. A prior appropriator of the waters of a stream is entitled to an injunction against appropriation by another, where the taking by the latter is not sufficiently complete and definite to afford a measurement of the damages suffered by the prior appropriator.</p>
