Syllabus

<p>1. A judgment of a court of competent jurisdiction in a common law action may be directly attacked in chancery by the judgment debtor upon the ground that there had been no service of process upon him in the action and that he had and has a perfect defense in whole or in part to the action.</p> <p>2. A direct attack in equity upon a judgment at law presents for consideration- no error of law, but should present a fact which if it had been known to the court rendering the judgment at the time would have prevented its rendition.</p>
