Syllabus
<p>Judgment — Opening judgment — Discretion of court.</p> <p>A rule to open a judgment is an equitable proceeding addressed to tbe sound discretion of tbe court below. The refusal to open a judgment will not be reversed by the appellate court where there is no evidence of an abuse of such discretion, and the record shows that the defendant had not adduced sufficient proof to warrant the court in submitting the ease to a jury.</p>
