Under the criminal code of Illinois it is not necessary that there should be an unlawful assemblage to constitute a riot, though it was otherwise at common law. It is sufficient to constitute this offence that two or more persons, being together, actually do an unlawful act, with force and violence, against the person or property of another, or a lawful act in a violent or tumultuous manner.
