<p>MASTER AND SERVANT — BREACH OF RULES— FALSE EXCUSE — ASSAULT.</p> <p>1. The action is one sounding in damages. The plaintiff, a waitress, broke one of the rules of defendant’s restaurant, which required waitresses to. put off taking lunch until an hour appointed.</p> <p>2. She violated one of the commandments, when called upon to explain, and said that she had the permission of the head waitress, which, it seems, she had not obtained.</p> <p>3. A blow was struck, not as violent as charged.</p> <p>4. An employer should try to check and prevent any breaking of his rules, avoid great irritation, anger, and offensive expressions, and especially avoid inflicting a blow.</p> <p>(Syllabus by the Court.)</p>
