Decathlon Investments v. Michael P. Medeiros

Syllabus

The defendants, Michael Medeiros and Leonilde Medeiros, appealed from a Superior Court decree foreclosing their rights of redemption in property purchased by the plaintiff, Decathlon Investments, at a tax sale. On appeal, the defendants averred that the Superior Court did not have jurisdiction to enter a final decree because Decathlon Investments failed to comply with the procedures set forth in chapter 9 of title 44 of the general laws, which governs tax sales. Second, the defendants alleged that there was \a lack of due process\ because Decathlon Investments did not send language service notices as required by Executive Order 2012-05 of this Court. The Supreme Court held that the defendant's arguments were barred by the raise-or-waive rule. Accordingly, the Supreme Court affirmed the decree of the Superior Court.
