<p>It is of'the essence of estoppel by judgment' that it is certain that the precise fact was determined by the former judgment.</p> <p>Where the existence of a contract is a matter of doubt, equity will not, as a rule, decree specific performance, especially when it appears that the property to which it relates was rapidly rising in value.</p>
