Syllabus

<p>1. In a suit upon promissory notes, payable in dollars, where the defense pleaded is that by parol agreement they were payable in Confederate notes, it is not error to instruct the jury that the legal presumption is that the notes are payable in other currency than Confederate notes.</p> <p>2. Where a defendant relies for defense upon the illegality of the contract in which he participated, he must sustain his defense by clear evidence of such illegality.</p>
