Syllabus
<p>Trial — Verdict—Special Verdict. In an action by a trespasser for personal injuries sustained in being put off a moving freight train, a special verdict finding that the brakeman did not strike the plaintiff and knock him off the side of the car is inconsistent with a general verdict for the plaintiff, where there was no evidence of any other ground of recovery to sustain the general verdict; and it is error to deny defendant’s motion for judgment.</p>
