<p>SYLLABUS BY THE COURT.</p> <p>1. Certain provisions of Subdivision 4, of Rule XIII, adopted by this court March 22, 1912, are inconsistent with Section 21, Chap. 57, S. L. 1907, and where an appeal has been dismissed, for a failure to comply with a provision of such rule, clearly inconsistent with the statute, the order dismissing the appeal will be set aside and the cause reinstated.</p> <p>P. 324</p>
