<p>Oil and gas lease — Statute of frauds — Parol evidence — Modification of contract.</p> <p>In an action brought to recover royalties under a written oil and gas lease for the term of one year, with the right of renewal from year to year on an uncertain condition, parol evidence is admissible to show that, upon the lessee expressing an intention to abandon a well, the lessor agreed to waive the rental provided by the lease, in consideration of his receiving gas from the well for domestic purposes; the lessee to have the balance.</p>
