A demurrer to the evidence raises the question of the legal sufficiency of the evidence to prove the issue of fact in support of which it is offered, and an order sustaining it constitutes a decision by the court occurring at the trial, which cannot be reviewed by this court in the absence of a motion for a new trial.</p>
