<p>APPEAL AND ERROR — JURISDICTION OP APPELLATE COURT — AMOUNT IN CONTROVERSY.</p> <p>1. Where plaintiff, a judgment creditor in the sum of $147.10, seeks to revoke a transfer of certain real estate as far as it affects the execution of his judgment, and prays that the property be sold to pay his claim, the test of appellate jurisdiction is not the value of the tract of land conveyed, but the pecuniary amount of the judgment.</p> <p>2. In such a case this court will dismiss the appeal on its own motion for want of jurisdiction ratione materias.</p> <p>(Syllabus by the Court.)</p>
