Syllabus

<p>Mining Claims—Verbal Sale of.—The rule allowing mining claims-to bo transferred by a verbal sale and delivery of possession, only applies to cases where the grantor is in actual possession and can deliver possession to the grantee ; and does not extend to cases where at the time of the sale the claim is in the adverse possession of third parties. In such cases, there must be a written conveyance to pass the title.</p> <p>Table Mountain Tunnel Company v. Stranahan, 20 Cal. 198, commented on.</p>
