<p>Probate Court — Execution — Service by Constable. — In certain cases a constable may execute and return an execution issued out of a probate court and may justify under it, if it is valid on its. face. Under the provisions of section 3021 of the Revised Statutes, the transfer of the personal property described in the complaint was void as against the creditors of the seller thereof. Under the facts of the ease no demand was necessary before beginning this action.</p> <p>(Syllabus by the court.)</p>
