<p>Action—Tortious taking of property may be waived and value recovBRED IN ASSUMPSIT.</p> <p>Where there has been a tortious taking or detention of property, which has not been sold by the tort-feasor, owner may waive the tort and recover the fair value thereof in an action of assumpsit upon an account for goods sold and delivered.</p>
