Syllabus

<p>Affidavit of defense — Practice, G. P. — Bond—Sheriff—Misfeasance.</p> <p>In an action of assumpsit on the official bond of a sheriff, where the action is founded on the misfeasance or negligence of the sheriff in permitting the escape of a husband arrested for nonsupport, no affidavit of defense is required.</p> <p>Where no affidavit of defense is required, the filing of one whether good or not is immaterial.</p>
