<p>Appeals — Actual controversy — Habeas corpus — Smallpox quarantine.</p> <p>The rule that the existence of an actual controversy is an essential to an appellate jurisdiction, is applicable to a case where the lower court has refused a writ of habeas corpus to relieve persons restrained of their liberty by smallpox quarantine, and such persons have been released before an appeal from the order refusing the writ, has been heard.</p>
