Syllabus

<p>Partition — Lunatio—Principal and surety.</p> <p>Where an allottee in partition proceedings has entered a recognizance with sureties to secure payment of the valuation money, and the allottee has subsequently been appointed committee in lunacy of one of the persons entitled to the valuation money, and as committee has filed a bond with sureties, and also as committee has filed an account which has been confirmed, the administrator of the lunatio cannot bring suit upon the recognizance for the valuation money. In such a case the administrator must look to the committee or the sureties on his bond for payment.</p>
