Syllabus
Judgment of the Franklin County Municipal Court is affirmed. This court finds no abuse of discretion by the trial court in denying the continuance of the hearing appointing a receiver given the court's explicit prior warning there would be no more continuances, delays from appellant's unsuccessful disqualification affidavits, and lack of corroborating evidence beyond the appellant's allegations regarding the scheduling mishap. Appellant's second assignment of error regarding the trial court not ruling on appellant's July 7, 2025 Civ.R. 60(B) motion is overruled as the appeal filed July 16, 2025, divested the trial court of jurisdiction over the motion. Appellant's third, fourth and fifth assignments of error are raised for the first time on appeal and therefore we decline to address them.
