<p>WITHHOLDING POSSESSION OF REAL PROPERTY — DAMAGES — EVIDENCE OF RENTAL VALUE.</p> <p>Although an action for the recovery of damages for the detention of premises may be in form one for trespass, rental value is provable as an element of damages, since, under Code Proc., §§ 214, 534, such an action is treated as if it were one of contract. (Dunbar, J., dissents).</p>
