Syllabus

Change of Venue—When Properly Denied.—In this case the court denies a motion, made on behalf of all the defendants except Dore and McNealy, to change the place of trial to San Diego county, where real estate affected by the action is situated, because the true basis of the action is fraud and collusion rather than the recovery or determination of any interest in realty, and because Dore is a resident of San Francisco, and a necessary party, and McNealy opposes the motion.
