<p>Mechanics’ lien—contract to furnish materials. Under the act of 1845, creating a lien for labor and materials furnished for the erection of a building, it is necessary to create a lien that a time should be specified within which under the contract they should be furnished. An agreement to furnish them within a reasonable time does not cure the omission to name a specific time, and does not create a lien. Had the contract been entered into and the materials furnished since the adoption of the act of 1861, it might probably have been otherwise.</p>
