<p>1. Appeal and Error. Bond. School fund depository. Necessity of Bonds.</p> <p>In an action for mandamus to require payment of a warrant on school funds in its hands, a bank which was a depository of such funds was not entitled to appeal without bond under Code 1906, section 94 (Hemingway’s Code, section 76).</p> <p>2. Same.</p> <p>Where the bank in such case appealed to the supreme court without bond, the court had the ppwer to permit it to supply such bond under Code of 1906, section 4913 (Hemingway’s Code, section 3189).</p>
